In Washington state, all Realtors should be retaining and storing their text messages as material correspondence in the transaction file. In a recent court case, the court ruled that what was said in a text message between two realtors created a legally binding contract.
Whether your state requires it yet or not, it’s a good idea to include a copy of all communications–including text messages–in the transaction file.
